Waiver of Liability for Property Access
I (Participant) hereby acknowledge that I have been granted access to the property owned by Decay Devils INC. located at 251 Broadway, Gary, IN ("the Property"). In consideration of being permitted to enter and use the Property, I agree to the following terms and conditions:
1. Assumption of Risk: I understand and acknowledge that there are inherent risks associated with being on the Property, including but not limited to the risk of personal injury, property damage, and exposure to hazardous conditions. I voluntarily assume all risks associated with my presence on the Property.
2. Release of Liability: I hereby release, waive, discharge, and covenant not to sue Decay Devils INC., its owners, employees, agents, representatives, successors, and assigns (collectively referred to as "the Released Parties") from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to my access to or use of the Property, including but not limited to those arising from the negligence or fault of the Released Parties.
3. Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all losses, liabilities, damages, costs, or expenses, including reasonable attorneys' fees, incurred by the Released Parties as a result of my actions or conduct while on the Property.
4. Exclusion of Decay Devils Organization: I specifically acknowledge and agree that the terms of this waiver of liability do not extend to the Decay Devils organization or any of its members, affiliates, or representatives. I understand that the Decay Devils organization is not responsible for any incidents, accidents, or injuries that may occur while I am on the Property.
5. Severability: If any provision of this waiver of liability is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
6. Governing Law: This waiver of liability shall be governed by and construed in accordance with the laws of Indiana.
By signing below, I acknowledge that I have read and understand the terms of this waiver of liability, and I voluntarily agree to be bound by its terms and conditions.
